Terms of service

Terms of service

These terms apply to your use of this website and to orders placed on it by retail customers. Orders from trade customers are also subject to our trade Terms of Sale.

  1. About us. This website is operated by Hilton International Eyewear Ltd (1985) (trading as Hilton Eyewear), a company registered in England and Wales under number 1955329, with its registered office at Unit 21 Sapcote Trading Centre, 374 High Road, London NW10 2DH. VAT number GB 441905852. You can contact us at websales@hilton-eyewear.com or on 020 8451 7800.
  2. Orders. When you place an order, we will email you to acknowledge it. Our acceptance of your order takes place when we confirm dispatch, at which point a contract is formed between us. We may decline an order, for example if an item is out of stock, if there is an error in the price or description, or if we are unable to supply lenses to the prescription given. If we decline an order after payment, we will refund you in full.
  3. Prices and payment. Retail prices are in pounds sterling and include VAT at the current rate. Delivery charges are shown at checkout and in our Shipping Policy. Payment is taken when you place your order.
  4. Prescriptions. If you order prescription lenses, you are responsible for providing a valid, current prescription issued by a qualified optometrist or ophthalmic practitioner. We will make the lenses to the prescription you give us. Please check your prescription carefully before submitting it. Prescription lenses are not a substitute for regular eye examinations. If you cannot get used to your lenses, our 1-month non-tolerance guarantee in the Refund Policy applies.

  5. Delivery. Delivery times and charges are set out in our Shipping Policy. The goods are your responsibility from the time they are delivered to the address you gave us.

  6. Cancellations, returns and faulty goods. Your right to cancel, and our returns and warranty terms, are set out in our Refund Policy. Nothing in these terms affects your legal rights as a consumer.
  7. Our liability. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses. We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.
  8. Events outside our control. We will not be responsible for delays or failure to perform caused by events outside our reasonable control. If such an event affects your order, we will contact you as soon as possible.
  9. Use of this website. The content of this website, including images, designs and text, belongs to us or our licensors and may not be copied without our permission. We try to make sure that product descriptions, colours and sizes are accurate, but colours may vary slightly depending on your screen.
  10. Law. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

Trade terms of sale

These are the trade Terms of Sale under which Hilton International Eyewear Ltd (1985) ("the Company") supplies goods to trade customers ("the Customer"). They apply to all trade orders, whether placed online, by phone, by email or in person.

1. Definitions. "The Company" means Hilton International Eyewear Ltd (1985). "The Customer" means the person or organisation buying from the Company in the course of business, including any customer with a trade or credit account. "Goods" means the goods supplied by the Company.

2. Payment.

  • a) Standard payment terms for customers with agreed credit accounts are 30 days from the date of invoice. Customers ordering online may choose to pay at checkout or to pay on account. Orders from customers who do not have an agreed credit account will only be accepted against payment in full.
  • b) Any extension of time to pay is only effective if agreed in writing by the Company. Amounts may not be withheld or delayed by the Customer for unauthorised returns or otherwise without the Company's written agreement.
  • c) The Company reserves the right to charge interest on overdue amounts, calculated daily from the due date until payment is received, at 3% per year above the Bank of England base rate in force from time to time.
  • d) All costs incurred in recovering overdue debts, including legal expenses, are payable by the Customer.
  • e) The Company may withhold further supplies or terminate this agreement if any amount is overdue, if these terms are breached, or for any other reason which at the Company's discretion warrants such action.

3. Property and risk.

  • a) Title to the Goods does not pass to the Customer until the Company has received payment in full for those Goods and all other amounts due from the Customer on any account.
  • b) Until title passes, the Customer holds the Goods as bailee for the Company, must keep them in good condition, and must not dispose of, charge or encumber them, except that the Customer may sell them on arm's length terms in the ordinary course of its business.
  • c) Before title passes, the Company may end the Customer's right to sell the Goods and may enter the Customer's premises (or any other premises where the Goods are kept) to recover them.
  • d) If any part of this clause 3 is found to be invalid or unenforceable, the rest of the clause remains in effect, and the affected part applies with whatever modification is needed to make it enforceable.
  • e) Risk in the Goods passes to the Customer when they are delivered to the delivery address or, if the Customer collects them, when they leave the Company's premises. The Customer is responsible for insuring the Goods from that time.

4. Returns and warranty.

  • a) Faulty Goods are accepted for return only where the Goods have a manufacturing fault, are within their warranty period, and are accompanied by the Company's completed returns form. For Senator, Soho Junior, Philip and Charles frames, a photograph of the fault sent by email with the returns form is sufficient; for all other brands the Goods themselves must be returned. Goods returned for any other reason must be unused and in saleable condition, and are subject to a restocking fee of 15% of the invoiced price.
The returns form is available at Hilton trade returns form (PDF).
  • b) The Hilton collection carries a 2-year warranty, and all other house-brand collections carry a 1-year warranty, against manufacturing faults from the date of purchase from the Company.
  • c)

Prescription lenses made to order cannot be returned unless faulty or not made to the prescription supplied. Where the wearer cannot tolerate the lenses, the Company will remake them free of charge if notified within 1 month of delivery.

5. Claims and liability.

  • a) Damage to or shortages in Goods must be notified to the carrier and to the Company on delivery, or immediately on inspection after delivery, and confirmed in writing within 5 days of delivery. Claims for non-delivery must be made in writing within 14 days of the invoice date. Claims notified outside these periods will not be considered.
  • b) Except as set out in these terms, and to the extent permitted by law, the Company gives no warranty as to the quality of the Goods or their fitness for any particular purpose, and is not liable for any indirect or consequential loss, loss of profit or loss of business arising from the supply of Goods, or from non-delivery, delayed delivery, or damage to or loss of Goods, including where caused by events outside the Company's control such as fire, flood, accident, strikes, industrial action, terrorism, war or government action.
  • c) Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
  • d) The Customer must notify the Company in writing of any claim of infringement of any patent, copyright, design, trade mark or other intellectual property right in the Goods of which it becomes aware.

6. Termination.

  • a) This agreement terminates immediately if the Customer becomes bankrupt, passes a resolution for winding-up, is unable to pay its debts within the meaning of section 123 of the Insolvency Act 1986, makes an arrangement with its creditors, or has a receiver, administrator or similar officer appointed over any of its assets.
  • b) The Company may terminate this agreement at any time if these terms are breached by the Customer.
  • c) Termination does not affect any rights or obligations that arose before termination.

7. Overseas customers. Goods supplied to overseas Customers are supplied FOB, except where FOB conditions conflict with these terms, in which case these terms prevail. Delivery to the Customer's UK shipping agent counts as delivery to the Customer. Unless otherwise agreed in writing, the Customer is responsible for all duties, levies, taxes and other charges arising on export of the Goods from the UK and their import overseas.

8. General.

  • a) No variation to these terms is binding unless agreed in writing by authorised representatives of the Company and the Customer.
  • b) By placing an order or accepting delivery, the Customer agrees to be bound by these terms, which apply in place of any other terms the Customer may put forward.
  • c) These terms are governed by the laws of England and Wales, and disputes are subject to the non-exclusive jurisdiction of the English courts.
